As between AdversTic and you, all title, ownership rights, and intellectual property rights in and to the Site—including any modifications, improvements, or derivative works—remain the exclusive property of AdversTic. WE DO NOT WARRANT THAT THE SITE OR ITS FUNCTIONS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

IN NO EVENT SHALL ADVERSTIC, OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF ADVERSTIC IS FOUND LIABLE, OUR AGGREGATE LIABILITY SHALL NOT EXCEED FIVE US DOLLARS (US $5.00).

8. Termination

AdversTic reserves the right, in its sole discretion, to suspend or terminate your access to the Site, in whole or in part, at any time and for any reason without prior notice. Upon termination, all rights granted to you under these TOU will immediately cease, and the provisions of Sections 5 (Limitation of Liability and Disclaimers), 6 (Indemnification), 10 (General Provisions), and any other provisions intended to survive termination shall remain in effect.
